1998 Act

 In terms of the 1998 Act, the Fund compensates only if fault has been established against a driver of a motor vehicle. Where there is no fault pertaining to the cause of the road crash, the Fund would not pay out compensation. Compensation here entails General Damages [i.e. pain and suffering, permanent disability, etc], Medical Assistance, Funeral Expenses, Loss of Earnings, Loss of Support, Solatium for Grief and Incidental Expenses.
